TERMS & CONDITIONS
Applicable to all Quotations and Invoices | Effective 2025
1. GENERAL
Gainsford Designs (Pty) Ltd (‘Gainsford Designs’, ‘we’, ‘us’) is a custom craft and design business based in Bloemfontein, South Africa. These Terms & Conditions govern all quotations, invoices, and transactions between Gainsford Designs and its clients (‘consumer’/’you’) and are governed by the Consumer Protection Act No. 68 of 2008 (‘CPA’) and all applicable South African law.
2. QUOTATIONS
All quotations are valid for 7 (seven) calendar days from the date of issue unless otherwise stated in writing.
Quotations are based on the specifications, materials, colours, and dimensions discussed and confirmed with you at the time of quoting.
By accepting a quotation, you confirm that you have reviewed all specifications and are fully satisfied with the proposed scope, materials, and pricing.
Once a quotation is accepted and a deposit received, no changes to specifications, materials, or dimensions can be accommodated without a revised quotation and possible price adjustment.
We do not charge for the preparation of quotations or estimates.
Important: Please ensure you are completely satisfied with the type of material, size, colour, and all specifications before accepting the quotation, as all our products are custom-made to your unique requirements and cannot be reworked without additional cost. |

3. PAYMENT TERMS
3.1 Projects above R2 500.00
A minimum deposit of 80% of the total quoted amount is required before any work is scheduled or commenced.
The remaining 20% balance is due upon completion and prior to release of the finished product.
3.2 Projects of R2 500.00 and below
Full payment is required in advance before work is scheduled.
3.3 General payment terms
Payment must be made via Electronic Funds Transfer (EFT). We do not accept cash payments for invoiced projects.
Work will only be scheduled once payment is verified and cleared in our account.
Completed products/projects will only be released once the account is settled in full.
All materials remain the property of Gainsford Designs until the account is settled in full.

4. CUSTOM-MADE GOODS
All products and projects produced by Gainsford Designs are custom-made (handcrafted) to your specific requirements. As a result:
All materials are measured, cut, and sized specifically for your project.
We do not replicate, clone, or reproduce existing products from sample pictures. Every product is uniquely handcrafted.
We do not accept returns or exchanges due to a change of mind once a custom order has been confirmed and production has commenced. This is consistent with the CPA in respect of bespoke goods.
5. QUALITY WARRANTY — YOUR RIGHTS UNDER THE CPA
Gainsford Designs warrants that all goods supplied will comply with the standards set out in Section 55 of the Consumer Protection Act, namely that goods will be:
Reasonably suitable for the purpose for which they are generally intended;
Of good quality, in good working order and free of defects;
Useable and durable for a reasonable period of time given the nature of the product.
5.1 Six-month implied warranty
In terms of Section 56 of the CPA, an implied warranty of quality applies for 6 (six) months from the date of delivery or collection of the goods. If, within this period, a product is found to be defective, not of acceptable quality, or does not conform to the agreed specifications, you are entitled to:
Have the goods repaired;
Have the goods replaced; or
Receive a full refund of the price paid.
Important: The choice of remedy (repair, replacement, or refund) is yours as the consumer. Gainsford Designs cannot prescribe which remedy you must accept. This statutory warranty cannot be waived or excluded by any policy or agreement. |

5.2 Exclusions
The implied warranty does not apply where:
The defect or damage was caused by misuse, negligence, or alterations made by you or a third party after delivery.
You were made aware of a specific defect or limitation before accepting the quotation and agreed to proceed.
Normal wear and tear consistent with the nature and use of the product.
6. DEFECTS & REPAIRS
Should you identify a defect or require a repair on any Gainsford Designs product after the 6-month warranty period:
We will gladly assess the issue and provide a free written quotation for the repair.
Approved repair work will be charged at the rate quoted and agreed in writing.
Gainsford Designs does not provide a delivery or courier service. Arrangements for transporting items to and from our premises for repair are the responsibility of the consumer, at the consumer’s cost.
7. YOUR RIGHTS AS A CONSUMER (CPA)
Your rights under the Consumer Protection Act No. 68 of 2008 include, but are not limited to:
The right to receive goods of good quality, free of defects, and suitable for their intended purpose (Section 55).
The right to a repair, replacement, or refund for defective goods within 6 months of delivery (Section 56).
The right to choose your preferred remedy — repair, replacement, or refund — in the case of defective goods.
The right to full disclosure of pricing, terms, and conditions before accepting a quotation.
The right to have your personal information handled in accordance with the Protection of Personal Information Act (POPIA).
Nothing in these Terms & Conditions limits, excludes, or waives any right you have in terms of the Consumer Protection Act. Any clause that purports to do so is void and unenforceable.
8. PROTECTION OF PERSONAL INFORMATION (POPIA)
By accepting a quotation or engaging with Gainsford Designs, you consent to Gainsford Designs retaining your personal information for the purpose of project communication and record-keeping. Your personal information will not be shared with third parties, in accordance with the Protection of Personal Information Act No. 4 of 2013 (POPIA).
9. DISPUTE RESOLUTION
Should a dispute arise from any transaction with Gainsford Designs, we encourage you to first contact us directly so that we may resolve the matter amicably.
If a resolution cannot be reached, you have the right to refer the dispute to:
The Consumer Goods and Services Ombud (CGSO) — www.cgso.org.za
The National Consumer Commission (NCC) — www.thencc.org.za
Your provincial Consumer Court.
